Mercedes me ID Service Terms

Mercedes-Benz, USA, LLC with its registered office at One Mercedes-Benz Drive, Sandy Springs, GA 30328 (hereinafter “MBUSA,” “we,” or “us”), is the provider of the Mercedes me ID service (“Mercedes me ID Service”). The Mercedes me ID Service provides you with a central user account which can be used for the subscription to and/or the use of various other services, including online and offline services (the “Mme Services”) provided by Mercedes-Benz Group companies or third parties (each a “Mme Service Provider”). If you are under the age of 18, please make sure that your parents or legal guardians have given you permission to subscribe to and/or use the Mercedes me ID Service. If you are under the age of 13, you may not subscribe to or use the Mercedes me ID Service.

THESE TERMS CONTAIN A DISPUTE RESOLUTION AND ARBITRATION PROVISION, INCLUDING CLASS ACTION WAIVER THAT AFFECTS YOUR RIGHTS UNDER THESE TERMS AND WITH RESPECT TO DISPUTES YOU MAY HAVE WITH US. PLEASE SEE CLAUSE 13 FOR MORE INFORMATION.

These Mercedes me ID Service Terms (“Terms”) govern your subscription to and your use of the Mercedes me ID Service. It is required that you agree to the Terms. We therefore ask you to read them carefully.

Please note that the Terms only govern the Mercedes me ID Service. The Mme Services provided using your Mercedes me ID are subject to separate service terms to which you will be asked to agree if you decide to subscribe to and/or use those Mme Services. Some of the Mme Services may not be free of charge. Please also note that you may have to meet additional requirements in order to subscribe to and/or use certain Mme Services.

We reserve the right, in our sole discretion, to modify or change these Terms at any time. Your continued use of the Mercedes me ID Services following our posting of any changes to these Terms constitutes an acceptance of those changes.

To set up a Mercedes me ID, you must provide certain information during the registration process (“Mandatory Data”). In addition to Mandatory Data, you can voluntarily add additional information (“Voluntary Data”) to your Mercedes me ID (Mandatory Data and Voluntary Data together “Mercedes me ID Data”) in order to enhance your user experience and to simplify the subscription process for certain Mme Services. The more information you add to your Mercedes me ID, the less information you are likely to be asked to provide when subscribing to and/or using another Mme Service. We encourage you to keep your Mercedes me ID Data updated at all times.

When you subscribe to and/or use a Mme Service, the Mme Service Provider is granted access to your Mercedes me ID Data which is required for the subscription to and/or the use of that Mme Service.

You have been informed and you understand that in order to provide you with the Mercedes me ID Service, we will process your personal data, i.e., any information relating directly or indirectly to you (such as your name, your e-mail address, etc.). We will process your personal data in accordance with applicable data protection laws and our Privacy Statement.

Please use unique login credentials for your Mercedes me ID. Keep your Mercedes me ID credentials confidential and do not disclose them to third parties. You are responsible for all activities carried out under and/or in connection with your Mercedes me ID. You must not use the Mercedes me ID Service in any way that is not permitted by law or that may violate any third party rights.

All intellectual property rights in the Mercedes me ID Service remain with us; we do not grant you any right to use any logo or trademark and/or other of our intellectual property without our prior permission.

In order to be able to subscribe to and/or use the Mercedes me ID Service, you need to have an active e-mail account and an internet-connected mobile or stationary device (e.g., your smartphone, tablet, desktop computer, laptop, etc.). You may access the Mercedes me ID Service from any standard browser.

Please note that the subscription to and/or use of certain Mme Services may be subject to further technical requirements, which will be separately identified by the relevant Mme Service Provider.

Although we will make reasonable efforts to make the Mercedes me ID Service available for use, we reserve the right to temporarily limit, restrict, or suspend the Mercedes me ID Service from time to time in order to maintain, restore, and/or improve the access to and/or the availability, security, and integrity of the Mercedes me ID Service.

Under no circumstances shall MBUSA be liable for any direct, indirect, punitive, special, incidental, or consequential damages, whether in contract or tort, including, without limitation, loss of data, income, or profits, even if MBUSA has been advised of or should have known of the possibility of such damages, arising from the use of or inability to use the Mercedes me ID Service or from any information, content, materials, products, or Mme Service included on or otherwise made available to you through the Mercedes me ID Service. 

MBUSA MAKES NO WARRANTY CONCERNING ANY DELAY, FAILURE, INTERRUPTION, OR      CORRUPTION YOU MAY EXPERIENCE VIEWING OR USING ANY CONTENT, SOFTWARE, FUNCTIONS, SERVICES, MATERIALS, OR INFORMATION TRANSMITTED IN CONNECTION WITH THE USE OF THE MERCEDES ME ID SERVICE. MBUSA FURTHER MAKES NO WARRANTY WITH RESPECT TO SUPPORT FOR THE MERCEDES ME ID SERVICE. YOU EXPRESSLY AGREE THAT YOUR USE OF THE MERCEDES ME ID SERVICE IS AT YOUR SOLE RISK AND RESPONSIBILITY. THE MERCEDES ME ID SERVICE IS PROVIDED “AS IS.” TO THE FULLEST EXTENT PERMISSIBLE BY LAW, MBUSA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, FOR THE OPERATION OF THE MERCEDES ME ID SERVICE OR THE TRANSMISSION OF ANY INFORMATION THROUGH THE MERCEDES ME ID SERVICE. FURTHER, MBUSA EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OR USE. MBUSA DOES NOT REPRESENT OR WARRANT THAT THE MERCEDES ME ID SERVICE WILL BE UNINTERRUPTED, ERROR FREE, FREE OF VIRUSES, WORMS, TIME BOMBS, DROP DEAD DEVICES, TROJAN HORSES, OR OTHER HARMFUL COMPONENTS.

You may delete your Mercedes me ID at any time. Please note that deleting your Mercedes me ID means you will not be able to use any Mme Services that require a Mercedes me ID. If you would like to continue use certain Mme Services after deleting your Mercedes me ID, you will have to re-register for a new Mercedes me ID and you may be charged a fee to reactivate certain Mme Services.

We reserve the right to terminate the Mercedes me ID Service at any time for any reason. We will immediately suspend or terminate  your use of the Mercedes me ID Service if we suspect fraud or other misuse of your Mercedes me ID or Mercedes me ID Service.

ANY DISPUTE OR CLAIM ARISING OUT OF, RELATING TO, OR IN CONNECTION WITH THESE TERMS SHALL, TO THE EXTENT PERMITTED BY LAW, BE RESOLVED BY BINDING ARBITRATION, RATHER THAN IN COURT. IT IS IMPORTANT THAT YOU UNDERSTAND THAT BY ENTERING INTO THESE TERMS, YOUR ARE WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

Arbitration shall be conducted in accordance with the American Arbitration Association’s (“AAA”) commercial arbitration rules, or, if applicable, the supplementary procedures for the resolution of consumer related disputes. Consolidated or class action arbitrations shall not be permitted.

Arbitration hearings shall be held in the state of Georgia. Any disagreements regarding the location in which arbitration hearings will be held shall be settled by the arbitrator.

If you initiate arbitration, your arbitration fees will be limited to the filing fee set forth in AAA’s consumer arbitration rules. Regardless of who initiates arbitration, we will pay your share of arbitration fees (not including your attorneys’ fees) up to a maximum of $2,500. If the arbitrator rules against us, in addition to accepting whatever responsibility is ordered by the arbitrator, we will reimburse your reasonable attorneys’ fees and costs up to a maximum of $5,000, regardless of who initiated the arbitration, unless the arbitrator finds some or all of your claims to be frivolous or to have been brought in bad faith. In addition, if the arbitrator rules in our favor, we will not seek reimbursement of our attorneys’ fees and costs, regardless of who initiated the arbitration, unless the arbitrator finds some or all your claims to be frivolous or to have been brought in bad faith.

THE ARBITRATOR'S DECISION WILL BE CONCLUSIVE AND BINDING AND MAY BE ENTERED AS A JUDGMENT IN ANY COURT OF COMPETENT JURISDICTION.

Any claim under these Terms must be brought within one (1) year after the cause of action arises, or such claim is barred.

Nothing herein shall be construed to preclude any party from pursuing qualified claims in small claims court nor from seeking injunctive relief in state or federal court. For such claims, you agree to the personal jurisdiction of and venue in the state and federal courts in Fulton County, Georgia, and waive any objection to such jurisdiction or venue.

You agree that all matters relating to your Mercedes me ID and the Mercedes Me ID Service, including all disputes, will be governed by and construed in accordance with the laws of the State of Georgia without regard to its conflicts of laws provisions.

If for any reason a court of competent jurisdiction finds any provision of these Terms, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of these Terms, and the remainder of these Terms shall continue in full force and effect.

1. The Mercedes me ID service enables you to create a single user account to login to all websites and applications of Mercedes-Benz USA, LLC and the Mercedes-Benz Group linked to this service. Your user account and password give you personalized access to the corresponding websites and applications.
2. For security reasons your password must meet the following criteria:
   1. Minimum of 8 characters
   2. Meets a minimum of three of the following criteria:
      • Contains upper case letters
      • Contains lower case letters
      • Contains at minimum one digit
      • Contains at minimum one special character

Do not use a password merely consisting of one or several dictionary entries and digits. Do not share your password with anyone and change it regularly. You can change your password at any time by accessing the user account settings. You are responsible for securely handling your password. Mercedes-Benz USA, LLC shall not assume any liability for non-compliance with these password rules.

1. Your user name corresponds to the email address stated during registration. All required information regarding the use of your user account will be sent to this email address. You may change your email address / user name at any time by accessing the user account settings.
2. This access service enables you to use your existing social network user credentials for registration and login. Your data from social networks can be used for registrations to automatically complete your registration form. The data will be transferred only if you previously granted the Mercedes me ID service access to certain data of your social network profile. The Mercedes me ID service will transfer the data shown in the registration window and your identification number within the social network from your social network profile. After successful registration you may simplify the login procedure by using the "Social Network Login" button. In this case, if you have already logged on to the social network, the authentication information of the social network is transferred and you are not required to take any other actions. Please note that using the registration and login via social network function enables social network providers to retrace your registration to the Mercedes me ID service as well as individual login processes.
